Councillors vote to proceed despite 'incomplete' application

UXBRIDGE -- A developer is hoping to fast-track zoning approval for a new residential development in Uxbridge's downtown, despite submitting an incomplete application to the Township.
Domenic Di Bernardo, of Sunpark Developments Inc., wants to create an affordable housing building with a commercial component at the former Williamson GM site on Douglas Road. The problem is, zoning there currently doesn't permit housing, and he wants to get moving on the project.
"My time for due diligence is quickly coming to an end," as there is a time constraint in the purchase agreement regarding the property, explained Mr. Di Bernardo in a letter to councillors. "In order to be able to arrange the financing, I need to confirm that the residential zoning is in place."
But Richard Vandezande, manager of planning for Uxbridge, said the rezoning application submitted by the developer is not complete. Under Ontario's planning act, a full application is needed to proceed, he said.
"I cannot go to a public (rezoning) meeting with an incomplete application," said Mr. Vandezande during a Feb. 1 committee meeting.
Added Councillor Jack Ballinger, "There's new legislation (from the Province) ... certain conditions have to be filled."
Mr. Di Bernardo said he consulted a lawyer on the matter.
"I don't have to supply all studies for a bylaw amendment," he said.
Councillors engaged in extensive debate about the roadblock during the meeting.
"This is an opportunity to get residential taxes ... also giving a housing option not currently available. This is a win," said Coun. Howie Herrema.
Coun. Ballinger noted, "I think it's a wonderful idea (but) what guarantees do we have it will happen?"
Despite the information provided by Mr. Vandezande, councillors voted to deem the application complete, with a hold on the property until certain requirements are met. A public meeting will be held near the end of March.
