Biker trial delayed as juror falls ill

Oct 28, 2008 - 03:23 PM

By Jeff Mitchell

WHITBY -- Just a day after it began the trial of two Hells Angels accused of plotting the murder of a rival was halted when a juror fell ill.

Superior Court Justice Bruce Glass sent the jurors home at about 9:30 a.m. Tuesday after a member of the panel indicated he was sick. It's not yet known if the trial will resume Wednesday.

On trial are Remond Akleh and Mark Stephenson, two members of the Hells Angels accused of plotting to murder a rival. Mr. Stephenson, of Sunderland, and Mr. Akleh of Northumberland County have pleaded not guilty to conspiracy to commit murder and counselling to commit murder.

The alleged plot was never carried out, court has heard.

The jurors, who were picked during a lengthy selection process in Whitby last week, began hearing evidence Monday. The first witness, a police officer with the provincial Biker Enforcement Unit, testified for a few hours before court concluded Monday.

Earlier that day Crown Attorney John Scott outlined for jurors what he anticipated will be evidence at trial. The Crown alleges Mr. Akleh and Mr. Stephenson conspired with another Hells Angels member to kill Frank Lenti, a rival biker with ties to the Bandidos club.â?¨ The would-be hitman was actually a police agent gathering information on drug dealing by outlaw bikers, Mr. Scott said.
